The Committee of
Governmental Experts for Human Rights in Arab League
May be its
beginning of effective Arab juridical work?

All the literature and previous experience in the field of
human rights agreed the fact that a regional system of human rights would
achieve its desired goals assumed the availability of a number of
criteria, the most important one the existence of regional human rights
recognizes a set of basic human rights, obliges States to respect it,
working on Dedication and protect it , working to create control
mechanisms , and hold the trial on the States to work on respect human
rights in its various exercise, and it Constitute indicators of the
maturity of the regional system and the justification for its success.
Maat
sees that the rules of the Arab Human Rights suffers from real problems
in this regard, For the Arab Charter of Human Rights adopted by the Arab
Summit, Hosted by Tunisia in May 2004 and entered into force in March
2008, ratified by 10 countries until now, Namely Jordan, Algeria,
Bahrain, UAE, Palestine, Syria, Libya, Qatar, Yemen, Saudi Arabia, it
is clear that the length of the time period between the ratification of
the Charter and its entry into force of which was required for its entry
joining 7 States to the Charter which gives strong indications of
faltering steps in the field of Arab human rights.
For
the Arab Charter for the Rights of the Child, adopted in Tunis on 6/12/1983,
there are many calls need to amend it to make it more protected and
promote the Rights of the Child.
At
the level of human rights, commissions there are the Permanent Arab
Committee for Human Rights of the League of Arab States, which give rise
to other committees such as the preparation of the Charter.
The
last mechanisms in the Arab human rights field, which could have an
influential role in the march of Arab human rights, it is the Committee
of Governmental Experts for Human Rights in Arab League, It is derived
from the Permanent Arab Committee for Human Rights, The establishment of
this committee came for several important and necessary reasons, one of
it to find facility that specializes in the field of human rights provide
support and assistance through technical studies and research necessary
for the work of the Permanent Arab Committee for Human Rights, As well as
to make recommendations and proposals on topics related to human rights .
The
Committee of Experts to overcome some of the problems faced by the
permanent Arab Committee, the Arab Committee is representative for
governments, it is often not capable in terms of its composition, and
scope of its work to do studies and research freely, There is often a
reservation while the Committee of Experts on Human Rights where its
members have more freedom, and provide recommendations without reference
to the government.
Therefore,
Maat sees that this Committee could be an important addition to the
Arabic mechanisms for the protection and promotion of human rights, but
that is subject to several requirements first of it, on the selection of
members of the Committee, whose must be selected from the Arab human
rights competencies that have held the positions of relevant
international human rights or from eminent personalities of the human
rights at the national level, to take into account in the criteria for
nomination of experts as well as standards of expertise, competence,
impartiality and integrity, and to have the experience of different legal
systems .
Nomination
and selection of members should not be limited to the parties of
government so as not to interfere with the political and security
considerations in that, the organizations of civil society in Arab
countries must have a role in that, this requires that the nomination
procedures by States Parties are in full transparency and Publicity .
The
second thing that made available to the Commission full opportunity to
periodic and unannounced visits to Member States in the unconditional
form, it must have the opportunity to interact with all governmental and
non-governmental organizations and individuals in the States to
investigate certain facts and stand on the human rights situation in the
State concerned, also it Must be made available to the Commission the
possibility of action based on complaints received from individuals and
organizations within the States, in this case must be made available to
the Commission requested information and data with utmost transparency
and clarity.
Third,
that the committee should have representatives in each country involved
in human rights issues such as women, children, religious and ethnic
minorities and the development rights, political practice, and other, These
representatives have to enjoy relative immunity by governmental bodies in
countries in which they operate so as not to become vulnerable to
government harassment, the Committee must receive through their
representatives in states on the periodic reports from governments and
civil society organizations.
Finally,
in order not to influence the recommendations of the non-existent, there
must be a mechanism similar to the universal periodic review, which
created the Human Rights Council of the United Nations, Which the State
provide to the Committee to review periodically its work, including with
regard to its recommendations, and Committee's observations, as well as
to clarify the obstacles and problems that can be encountered and in this
case the committee can be submitted to the member State the technical
assistance and necessary technical to overcome obstacles, The committee
could also continue with the Arab and international donors to provide
material aid to the Member State.
We
would like to refer that Maat demands the Arab civil society
organizations to support the work of the Committee through permanent
communication with it on the one hand, publish the awareness of domestic
public opinion on the other, and pressure on policy makers and decision
makers in each country to activate the work of this Committee, on the
third, so as not to become a mere juridical decoration without any
effectiveness.

هل تكون بداية لعمل حقوقي عربي فعال ؟

اتفقت كل الأدبيات والتجارب السابقة في مجال حقوق الإنسان على
أن قيام أيّ نظام إقليمي لحقوق الإنسان كفيل بتحقيق الأهداف المرجوّة
منه يفترض توافر عدد من المعايير ، من أهمّها وجود وثيقة إقليمية لحقوق
الإنسان تقرّ مجموعة من الحقوق الإنسانية الأساسية وتلزم الدول باحترامها
والعمل على تكريسها وحمايتها والعمل على خلق آليات مراقبة ومحاكمة كفيلة بمحاسبة
الدول لدفعها للعمل على احترام حقوق الإنسان في ممارستها المختلفة ، ويشكل
كل ذلك مؤشرات على نضج هذا النظام الإقليمي ومبررات لنجاحه .
ويرى ماعت أن النظام العربي لحقوق الإنسان يعاني من مشكلات
حقيقية في هذا الصدد ، فبالنسبة للميثاق العربي لحقوق الإنسان الذي اعتمدته
القمة العربية، التي استضافتها تونس في مايو 2004 ودخل حيز النفاذ في
مارس 2008 ، و صادقت عليه حتى الآن 10 دول ، وهي الأردن
والجزائر والبحرين والإمارات وفلسطين وسورية وليبيا وقطر واليمن والمملكة
العربية السعودية ، ومن الواضح أن طول الفترة الزمنية بين المصادقة على
الميثاق و دخوله حيز النفاذ التي كان يشترط لدخولها انضمام 7 دول إلى
الميثاق يعطي مؤشرات قوية على تعثر الخطوات العربية في مجال حقوق الإنسان .
وبالنسبة لميثاق حقوق الطفل العربي الذي أقر في تونس في
6/12/1983 فهناك نداءات كثيرة بضرورة تعديله ليصبح أكثر حماية وتعزيزا
لحقوق الطفل ، وعلى صعيد اللجان المعنية بحقوق الإنسان فهناك اللجنة
العربية الدائمة لحقوق الإنسان التابعة لجامعة الدول العربية والتي تنبثق
عنها لجان أخرى مثل لجنة إعداد الميثاق مثلا .
أما أخر الآليات العربية في مجال حقوق الإنسان والتي يمكن أن
يكون لها دور مؤثر في المسيرة الحقوقية العربية فهي لجنة الخبراء الحكوميين
لحقوق الإنسان بالجامعة العربية، وهي منبثقة عن اللجنة العربية الدائمة
لحقوق الإنسان ، وجاء إنشاء هذه اللجنة لعدة أسباب مهمة
وضرورية، منها إيجاد آلية متخصصة في مجال حقوق الإنسان تقدم الدعم والمساعدة من
خلال الدراسات والأبحاث الفنية اللازمة لعمل اللجنة العربية الدائمة لحقوق الإنسان،
كذلك تقديم التوصيات والمقترحات في الموضوعات ذات الصلة بحقوق الإنسان
وتتغلب لجنة الخبراء على بعض المشكلات التي تواجه اللجنة
العربية الدائمة ، فاللجنة العربية ممثلة للحكومات وتكون في كثير من الأحيان
غير قادرة من حيث تركيبتها ونطاق عملها أن تقوم بحرّية بعمل الدراسات والأبحاث.
فكثيرا ما يكون هناك تحفظ بينما لجنة خبراء حقوق الإنسان يعمل فيها الأعضاء بشكل
أكثر حرية، وتقوم بتقديم توصياتها دون الرجوع للحكومات.
ومن هنا فإن ماعت يرى أن هذه اللجنة يمكن أن تكون إضافة هامة
إلى الآليات العربية لحماية وتعزيز حقوق الإنسان ، ولكن ذلك مرهون بعدة
اشتراطات أولها متعلق باختيار أعضاء اللجنة حيث يجب أن يتم اختيارهم من بين
الكفاءات الحقوقية العربية التي شغلت مناصب دولية في هذا الشأن أو من
الشخصيات الحقوقية البارزة على الصعيد الوطني ، وأن يراعي في معايير ترشيح
الخبراء إلى جانب معايير الخبرة والكفاءة والتجرد والنزاهة، أن يكونوا ممن
تتوافر لديهم الخبرة بالأنظمة القانونية المختلفة.
كما أن ترشيح الأعضاء واختيارهم يجب أن لا يكون قاصرا على
الأطراف الحكومية حتى لا تتدخل الاعتبارات السياسية والأمنية في ذلك ، بل
يجب أن يكون لمنظمات المجتمع المدني في الأقطار العربية دور في ذلك
ويتطلب ذلك أن تتسم إجراءات الترشيح من قبل الدول الأطراف بالشفافية
والعلانية الكاملة .
الأمر الثاني أن تتاح للجنة الفرصة الكاملة في إجراء الزيارات
الدورية والمفاجئة للدول الأعضاء بشكل غير مشروط ، كما يجب أن تتاح لها فرصة
التواصل مع كافة المنظمات الحكومية وغير الحكومية والأفراد في الدول من أجل
تقصي حقائق معينة والوقوف على الأوضاع الحقوقية في الدولة المعنية ، كما يجب
أن تتاح للجنة إمكانية التحرك بناءا على تلقي شكاوى من الأفراد والمنظمات
داخل الدول ، وفي هذه الحالة يجب أن تتاح للجنة ما تطلبه من معلومات وبيانات
بمنتهى الشفافية والوضوح .
الأمر الثالث أن يكون للجنة ممثلين في كل دولة معنيين بقضايا
حقوقية جزئية كالمرأة والطفل والأقليات الدينية والعرقية والحقوق التنموية
والممارسة السياسية وغيرها ، على أن يتمتع هؤلاء الممثلين بحصانة نسبية من
قبل الأجهزة الحكومية في الدول التي يعملون فيها حتى لا يصبحوا عرضة
للمضايقات الحكومية ، كما يجب أن تتلقى اللجنة من خلال ممثليها في الدول
تقارير دورية من الحكومات ومن منظمات المجتمع المدني .
وأخيرا وحتى لا تكون توصيات اللجنة معدومة التأثير يجب أن يكون
هناك آلية على غرار الاستعراض الدوري الشامل التي ابتكرها مجلس حقوق الإنسان
التابع للأمم المتحدة ، تقوم خلاله الدولة بتقديم استعراضها أمام
اللجنة على فترات دورية متضمنا ما أنجزته بخصوص توصيات وملاحظات هذه اللجنة
، وكذلك توضيح العقبات والمشكلات التي تعترضها ويمكن في هذه الحالة أن تقدم
اللجنة للدولة العضو المعونة الفنية والتقنية اللازمة لتجاوز العقبات ، كما
يمكن للجنة أن تتواصل مع الجهات المانحة العربية والدولية في سبيل تقديم
المعونة المادية اللازمة للدولة العضو .
يبقى أن نشير إلى أن ماعت يطالب منظمات المجتمع
المدني العربية بدعم عمل اللجنة من خلال التواصل الدائم معها من جهة ، ونشر
الوعي بها لدى الرأي العام الداخلي من جهة ثانية والضغط على صناع
ومتخذي القرار في كل دولة لتفعيل عمل هذه اللجنة من جهة ثالثة ، وذلك حتى لا
تتحول اللجنة الى مجرد ديكور حقوقي خالي من أي مضمون .
